Ohio Medical Malpractice Lawyers: Stringent Malpractice Laws Continue to Harm Injured Ohioans
March 31, 2015If you think medical malpractice lawsuits in Ohio are out of control, think again. Medical malpractice insurer Diederich Healthcare has released its annual Medical Malpractice Payout Analysis, and once again Ohio ranks among the states in which it is least likely that a medical malpractice victim will be fairly compensated for his or her injuries. Ohio’s per capita payout, the total paid out per person residing in the state, ranks 44 out of 50. With damage caps, restrictive lawsuit initiation procedures, and a tight statute of limitations, Ohio medical malpractice laws favor negligent medical professionals by making it difficult for those injured victims to recover the settlement or verdict they deserve. Any notion that Ohio medical malpractice lawsuits are out of control is nothing but skewed media hype.
Fact vs. Fiction
The truth about medical malpractice is that it happens all the time. 98,000 patients die each year as a result of preventable medical negligence, and hundreds of thousands more suffer non-fatal injuries. Of all of the instances of medical malpractice that occur, only a small number is recognized and identified as malpractice, and the number of lawsuits is even smaller still. While there are hundreds of thousands of instances of medical malpractice each year, malpractice filings are down nationally, in Ohio, and in the Cleveland/Cuyahoga area.
Not only are Ohio medical malpractice filings down, but the number of physicians practicing in Ohio is up, ranking 21st among states in the number per capita of physicians in active patient care. With so-called “tort reform” laws and the low per capita medical malpractice payout showing just how well they are shielded from liability, Ohio is ideal for physicians. Just not for injured patients.
